PROGRAM KERJA KBN JANUARI 2009 - DESEMBER 2012

Program KBN dikembangkan mengikuti capaian (yang belum seberapa) dari KBN dalam empat tahun pertamanya:
•mendukung dan memelihara jejaring antar perorangan dan organisasi di Indonesia dan internasional dalam masalah “bioetika”.
•melakukan dialog dalam diseminasi dan penjabaran “bioethics principles of the Universal Declaration of Bioethics and Human Rights (2005)”.
•menyelenggarakan diskusi terbuka dan lokakarya dengan berbagai pihak yang berkepentingan (lihat Catatan di bawah) dan tinjauan pemutakhiran “bioetika dan pembangunan di Indonesia”.
•mengembangkan dan melakukan evaluasi modul pendidikan bioetika untuk kelompok 12-18 tahun, khususnya mengenai bioetika dasar, bioetika lingkungan hidup dan keanekaragaman hayati, dan etika penelitian dan pengelolaan bencana; menggunakan format permainan, drama, dan studi kasus; dan menerapkan modul yang serupa untuk tingkatan pendidikan tinggi.
•membantu Prof. Sunarto Sastrowijoto, anggota International Bioethics Committee of UNESCO, dengan sekretariat kecil dan Kelompok Kerja Analis, untuk diskusi.
•berinteraksi dengan berbagai pusat bioetika regional, khususnya, mendukung, membantu, dan memenuhi undangan:
•The Bioethics Advisory Committee and the Ministry of Health would like to invite the Indonesian National Bioethics Commission to nominate one or two representatives to participate in the 8th Global Summit of National Bioethics Advisory Bodies from 26 to 27 July 2010. The Summit will be held immediately before the 10th World Congress of Bioethics (WCB), which will take place from 28 to 31 July 2010. More information on the WCB is available at: http://www.bioethics-singapore.org/wcb2010/
•menghadiri berbagai pertemuan khususnya Inter-governmental Bioethics Commitee UNESCO (IGBC); International Bioethics Commitee UNESCO (IBC); Conferences of the the Asian Bioethics Association; dan World Congress of Bioethics.
•berperan aktif dalam berbagi informasi di dalam: “the Second meeting of the European Commission International Dialogue on Bioethics (IDB), which will be organized by the European Commission in the first week of March 2010 in Madrid under the auspices of the Spanish rotation Council Presidency and the Spanish National Bioethics Council.
Invited participants at this event include the Members of the European Group on Ethics of science and new technologies (EGE), the Chairs of 15 non-EU National Ethics Councils, the Chairs of the National Ethics Councils of the 27 Member States of the European Union and the representatives of International Organisations.”

Kelompok sosial di tengah masyarakat dapat dilihat sebagai yang terdiri dari 9 (sembilan) major groups, seperti dalam “Agenda 21”, UN Conference an Environment and Development, Rio de Janeiro, 1992: (1) women, (2) children and youth, (3) indigenous people and their communities, (4) Non-governmental organizations, (5) local authorities, (6) workers and trade unions, (7) business and industries, (8) S&T communities, and (9) farmers.

Dari KEPUTUSAN FATWA MAJELIS ULAMA INDONESIA Nomor : 1/MUNAS VII/MUI/15/2005
Tentang PERLINDUNGAN HAK KEKAYAAN INTELEKTUAL (HKI), dapat kita simak beberapa butir penting di bawah ini:

“Dalam Fatwa ini, yang dimaksud dengan Kekayaan Intelektual adalah kekayaan yang timbul dari hasil olah pikir otak yang menghasilkan suatu produk atau proses yang berguna untuk manusia dan diakui oleh Negara berdasarkan peraturan perundangan-undangan yang berlaku. Oleh karenanya, HKI adalah hak untuk menikmati secara ekonomis hasil dari suatu kreativitas intelektual dari yang bersangkutan sehingga memberikan hak privat baginya untuk mendaftarkan, dan memperoleh perlindungan atas karya intelektualnya.

Sebagai bentuk penghargaan atas karya kreativitas intelektualnya tersebut Negara memberikan Hak Eksklusif kepada pendaftarannya dan/atau pemiliknya sebagai Pemegang Hak mempunyai hak untuk melarang orang lain yang tanpa persetujuannya atau tanpa hak, memperdagangkan atau memakai hak tersebut dalam segala bentuk dan cara.
Tujuan pengakuan hak ini oleh Negara adalah setiap orang terpacu untuk menghasilkan kreativitas-kreavitasnya guna kepentingan masyarakat secara lauas.

KETENTUAN HUKUM
1.Dalam Hukum Islam, HKI dipandang sebagai salah satu huquq maliyyah (hak kekayaan) yang mendapat perlindungan hukum (mashu) sebagaimana mal (kekayaan).
2.HKI yang mendapat perlindungan hukum Islam sebagaimana di maksud angka 1 tersebut adalah HKI yang tidak bertentangan dengan hukum Islam.
3.HKI dapat dijadikan obyek akad (al-ma'qud'alaih), baik akad mu'awadhah (pertukaran, komersial),maupun akad tabarru'at (nonkomersial), serta dapat diwaqafkan dan diwariskan.
4.Setiap bentuk pelanggaran terhadap HKI, termasuk namun tidak terbatas pada menggunakan, mengungkapkan, membuat, memakai, menjual, mengimpor, mengekspor, mengedarkan, menyerahkan, menyediakan, mengumumkan, memperbanyak, menjiplak, memalsu,membajak HKI milik orang lain secara tanpa hak merupakan kezaliman dan hukumnya adalah haram.”
Fatwa ini ditetapkan di Jakarta pada tanggal 22 Jumadil Akhir 1426 H, 29 Juli 2005 M.

Fatwa ini dapat kita golongkan ‘maju’. KBN sampai hari ini belum pernah melihat dan memeriksa keterkaitan antara bioetika, kekayaan intelektual, dan perlindungannya.

Dalam sejarahnya, konsep perlindungan kekayaan intelektual seperti yang kita kenal sekarang ini, lahir di Republik Venesia di abad ke lima belas, dengan rumusan yang sampai hari ini tidak mengalami banyak perubahan:
“We have among us men of great ingenious, apt to invent and discover ingenious devices …
Be it enacted that, by the authority of this Council, every person who shall build any new and ingenious device in this City, not previously made in our Commonwealth, shall give notice of it to the office of one General Welfare Board when it had been reduced to perfection so that it can be used and operated. It being forbidden to every other person in any of our territories and towns to make any further device conforming with and similar to said one, without the consent and license of the author, for the term of 10years. … .”

Nuffield Council on Bioethics : The Ethics of Research involving Animals

Research involving animals has been the subject of intense debate in the UK and elsewhere. Too often this debate is presented in a polarised manner, differentiating only between those ‘for’ or those ‘against’ all animal research. This is overly simplistic: there is a continuum of views between these two ends of the spectrum. This Report seeks to clarify the debate and aims to help people think through the ethical issues that are raised. The ways in which animals are used in different areas of research are reviewed, including: basic or ‘blue sky’ research, the development of new medicines and vaccines, and toxicity testing. The Report makes practical recommendations for future policy and practice, relating, among other things, to the use of GM animals, ways of improving the quality of debate, the implementation of the Three Rs (Refinement, Reduction and Replacement), and the responsibilities of researchers, reviewers and funding bodies.

The terms of reference of the Nuffield Council on Bioethics are:
1. to identify and define ethical questions raised by recent advances in biological and medical research in order to respond to, and to anticipate, public concern;
2. to make arrangements for examining and reporting on such questions with a view to
promoting public understanding and discussion; this may lead, where needed, to the
formulation of new guidelines by the appropriate regulatory or other body;
3. in the light of the outcome of its work, to publish reports; and to make representations, as the Council may judge appropriate.

Di Singapura, bulan Juli 2010, bioetika menjadi fokus regional

Tiga pertemuan internasional yang membahas bioetika akan berlangsung di Singapura dalam dua minggu terakhir di bulan Juli 2010. Ketiganya penting dan paket tiga-dalam-satu ini patut menjadi perhatian kita bersama. Ada dua pertemuan tanpa uang pendaftaran: yang pertama ialah yang dituan-rumahi oleh Asian Bioethics Association yang berlangsung tanpa uang pendaftaran Pertemuan ini ialah The Eleventh Asian Bioethics Conference, 31 Juli – 2 Agustus 2010. Yang kedua ialah The Eighth Global Summit of National Boethics Advisory Bodies, juga tanpa uang pendaftaran. Ini akan dihadiri oleh perwakilan badan nasional yang mengurusi bioetika dan digelar tanggal 26-27 Juli 2010.

Di antara keduanya digelar, sehingga menjadikannya back-to-back dengan yang dua di atas ini, The Tenth World Congress of Bioethics, 28-31 Juli 2010. Pertemuan empat hari ini menetapkan uang pendaftaran dalam kisaran sebesar S$ 1025 sampai S$ 1250.

Malaysian Biosafety Act enters into force

December 14 – The Malaysian government has implemented a new measure aimed at promoting biotechnology within the country, while complying with the standards set out by the Cartagena Protocol on Biosafety. The Malaysian Biosafety Act 2007 was approved by the House of Representatives and entered into force on 1 December 2009. With this approval, the Malaysian government will establish a National Biosafety Board, which will include representatives from seven Ministries and four experts from relevant fields.

In addition, the Genetic Modification Advisory Committee - a group of scientists responsible for assessing whether live modified organisms are safe to be released into the environment - is now expected to become a formal body. The Act is being hailed by others as an ambitious move to protect against the risks genetic modification could have on biodiversity and the environment, as well as a milestone in the creation of a legal framework for the biotech industry in Malaysia - one of the most biodiversity-dense countries in the world.
